Article 1 – General

  1. STM offers boat charters in the Balearics, self operated or via subcontractors depending of your booking.

  2. We reserve the right to change routes as well as start and end locations when weather conditions, shallows or other legitimate reasons so require. We will, as far as possible, inform passengers in a timely manner.

  3. The skipper is always in charge. Safety is paramount.

  4. By booking a ticket or chartering a boat you are accepting the terms and conditions of STM as well as from the operating charter company. These Terms & conditions can be requested from STM
     

Article 2 – Charters

1. Booking
Charters may be booked per person or as a private group. Reservations can be made via email, directly through our website, or through approved partner platforms such as Tripadvisor, Viator, etc.
2. Vessel Assignment and Substitution
Charters in the Balearic Islands are operated either on our own vessels or through trusted subcontractors, depending on your specific booking. In the event of technical issues, crew unavailability, or adverse weather conditions, we reserve the right to transfer your booking to an alternative vessel of equal or higher standard and service level.
3. Passenger Check-In
All passengers must arrive at least 5 minutes before the scheduled departure time at the agreed embarkation point.
4. Boarding and Accessibility
Boarding is either via gangway from the quay or by dinghy transfer to the moored vessel. Please note that our vessels are not wheelchair accessible unless explicitly stated otherwise in advance.
5.Onboard Facilities
Toilet facilities are available on most of our vessels and may be used free of charge, following the instructions provided by the crew.
6. Onboard Service and Alcohol Policy
Depending on the type of your booking, STM may offer an all-inclusive onboard service. This includes light alcoholic beverages such as beer and wine. Spirits may be available upon request. Please note that "all-inclusive" does not imply unlimited consumption. For safety reasons, STM reserves the right to restrict alcohol intake at its discretion.
7. Food and Beverage Policy
Passengers are not permitted to bring their own food or beverages onboard unless prior written approval has been obtained from STM or such permission has been explicitly communicated in advance.

Article 3 – Waiting periods and late start

1. In the case of shared charters there are no waiting times. This means that if you have purchased a ticket and arrive too late at the boarding point, the boat might not wait for you and STM can reassign your seats. Also, you will not be entitled to change the date or have the ticket refunded.
2.  In the case of private charters we will wait for you but depending on the captain and crew availability the waiting time is deducted from your charter time that was booked.

Article 4 – Transfers

  1. Passenger Contactability
    At the scheduled pickup time, at least one passenger must have a working mobile phone or similar communication device switched on and accessible via the number provided during booking.

  2. Confirmation of Pickup Details
    After booking, STM or our partner will confirm the pickup details via email or WhatsApp.

  3. Pickup Day Instructions
    On the day of your transfer, please be waiting outside at the designated location at the time specified in the confirmation message.

     

Article 5 – Execution of the Contract

  1. Cancellation Due to Weather
    The contract may be annulled in cases of severe weather (e.g., heavy storms or extreme sea conditions) that make the charter unsafe or unfeasible. The skipper has sole discretion in determining whether such conditions apply.

  2. Misconduct and Safety
    The skipper reserves the right to pause or terminate the charter immediately in cases of misconduct, including but not limited to behavior caused by alcohol or drug use. Guests who are visibly intoxicated at the start of the trip will be denied boarding. In all such cases, the payment obligation remains.

  3. Alcohol Policy for Minors
    Alcohol consumption is strictly prohibited for passengers under 18. STM may request valid photo identification.

  4. Compliance with Instructions
    Passengers must follow all instructions from STM and its staff without delay. Access to the vessel or boarding area may be denied without further justification in cases involving safety concerns, overcapacity, public order, or potential risk of damage or disturbance.

     

Article 6 – Check-In and Departure Times

  1. Timely Arrival
    Passengers must arrive at the vessel at least 15 minutes before departure. Boarding closes 5 minutes before the scheduled departure with shared trips.
    For shared trips, late arrivals might be denied boarding and must pay the applicable fare to join a later excursion, if available.
    For private booked trips the missed time might be deducted from your booked scheduled time.

  2. Official Communication
    All departure times will be communicated via email, WhatsApp, or your stated preferred contact method. STM is not responsible for conflicting information from third-party sources.

     

Article 7 – Liability

Passenger Property
STM assumes no liability for damage to or loss of personal belongings. All personal property is brought on board at the passenger's sole risk.
Access and Boarding Risks
STM is not liable for any personal injury or damage to belongings incurred while accessing or boarding the vessel or any associated jetty. Entry is entirely at the passenger's own risk.

Article 8 – Passenger Liability

Damage to Property
Passengers are liable for any damage they cause to property or equipment belonging to STM or third parties.
Participation at Own Risk
All activities organized by STM are undertaken at the passenger’s own risk.
Recommended Insurance
Passengers are strongly advised to carry independent insurance for personal belongings (onboard and ashore), as well as coverage for medical expenses and emergency evacuation.
Exclusions
This agreement does not include Charterer’s Liability Insurance, nor Cancellation or Curtailment Insurance.
Medical Conditions
Passengers under medical treatment or with specific medical needs must disclose these in the travel agreement form prior to departure. All necessary precautions should be taken to ensure a safe and pleasant journey for both themselves and fellow passengers.
Food Allergies and Dietary Restrictions
Passengers must inform STM of any food allergies or dietary requirements at the time of booking. While STM takes reasonable precautions, it cannot guarantee meals are free of all allergens and accepts no liability for allergic reactions or related health issues.

Article 9 – General Liability

Limitation of Liability
STM is not liable for personal injury or damage of any kind before, during, or after the charter, unless resulting from deliberate misconduct or gross negligence by STM. In any case, statutory compensation is limited to the charter price paid for the affected booking.
Responsibility for Children
Children remain the sole responsibility of their parent(s) or guardian(s). Life jackets are available upon request.
Force Majeure
STM shall not be liable for failure to perform its obligations due to events of force majeure (e.g., natural disasters, governmental actions). No compensation or refunds are due in such cases.
Vessel Insurance
Each vessel is covered by liability and/or all-risk insurance, including coverage for bodily injury to passengers. This insurance meets or exceeds the requirements necessary to obtain a Spanish charter license.
Mandatory Passenger Insurance Spanish Government
As stated in the Terms and Conditions accepted upon booking our services, and reiterated in this charter agreement, the undersigned acknowledges and agrees that all passengers are covered by the mandatory insurance as required by Spanish law, specifically under Real Decreto 1575/1989, de 22 de diciembre, concerning passenger transport insurance in recreational nautical activities.
Our insurance policy provides coverage in accordance with these legal requirements, and this coverage represents the maximum liability and compensation available in the event of an accident or incident.
Insurance Provider Standards
Throughout the duration of this agreement, STM or its partner companies shall maintain insurance with reputable insurers, covering all customary risks for vessels of the respective size, type, and value. The coverage shall not be less than what is required under Spanish charter regulations.
Availability of Insurance Documents
Upon reasonable request, STM will make copies of relevant insurance documentation available for inspection prior to the charter.
Charterer’s Own Insurance
Charterers are advised to obtain their own insurance for personal belongings, medical expenses, and emergency services during the charter period.

Article 10 – Payment, Cancellation, and Amendments

Booking Confirmation
Upon acceptance of our offer, a booking confirmation will be sent to the client.
Cancellation Procedure
All cancellations must be submitted in writing.
General Cancellation Policy
Cancellations made 14 days or more prior to departure are free of charge and the deposit will be fully refunded.
Cancellations made less than 14 days before departure will result in forfeiture of the deposit.
Note: Each subcontractor charter company may have its own cancellation policy, which can be provided upon request.
Weather Conditions
In the event of unsuitable weather, STM will propose a new date at no additional cost or offer a full refund of the payment made.
Amendments and Administration Fees
STM does not charge administrative fees for changes to bookings, including cancellations.
Shared Trips
STM reserves the right to cancel shared trips due to insufficient participants. In such cases, an alternative date will be proposed at no extra cost, or a full refund will be issued.

Article 11 – Final Provisions

Compliance with Crew Instructions
Passengers are expected to follow the instructions of the crew at all times, whether on the quay, jetty, or onboard.
Footwear Restrictions
For safety and to avoid damage, the wearing of stiletto heels is strongly discouraged.
Footwear Onboard
Depending on weather conditions, passengers may be asked to refrain from wearing shoes onboard.
Environmental Responsibility
Passengers are expected to respect the marine environment. Waste must not be disposed of in the water. All personal consumption waste must be removed from the vessel at the end of the charter.
Errors and Omissions
STM is not bound by obvious errors or mistakes in published or provided information. European consumer law applies to these terms and conditions.

 

Article 12 – Governing Law and Jurisdiction

Jurisdiction
Any disputes arising from this agreement shall be submitted to the competent court in the flag state of the vessel.
Applicable Law
These Terms and Conditions, agreed to upon booking a ticket or chartering a vessel through STM, are governed by and construed in accordance with Belgian law. All parties submit to the exclusive jurisdiction of the Belgian courts.

 

Article 13 – Complaints

Immediate Notification
If a participant identifies a shortcoming in the performance of the agreement, STM must be informed as soon as possible so that a suitable solution can be sought.
Post-Charter Complaints
If the issue is not satisfactorily resolved during the charter, a formal complaint may be submitted in writing within 14 days after the conclusion of the activity. The complaint must clearly detail the nature of the issue.

 

Article 14 – Data Protection

Data Handling and Retention
In accordance with the European General Data Protection Regulation (GDPR), STM processes client data for the purpose of providing products and services. Data will be retained as long as the client relationship remains active, and for up to 5 years after the last transaction or service, unless earlier deletion is requested.
Personal data might be shared with subcontractors for communication purposes or third parties if legally required. Individuals have the right to confirm whether STM is processing their personal data, to access and correct inaccurate data, or to request deletion of irrelevant data.

Further information on how STM handles personal data is available in our privacy policy, which can be accessed online or sent via email upon request.

Article 16 – Definitions

FORCE MAJEURE: When force majeure is invoked in relation to breakdown or disablement, the Owner will instruct the Captain or Owner’s representative to  submit a detailed technical report, a copy of the vessel’s maintenance log, if applicable, and all relevant supporting documentation to the Charterer or Charterer’s representative.

PRICES: The prices listed on our website are indicative and marked with the term 'from,' as they vary between charter companies and are subject to fluctuations based on the season and group size. These prices serve as guidelines, and for accurate and personalized quotes, customers are required to request specific pricing via email. Additionally, please note that definitions of low, medium, and high seasons may differ among charter companies

ALL INCLUSIVE: Provisions on a boat are limited, we provide food and drinks as communicated on our website at convenient times, depending of the sea-state and the comfort levels during sailing. Drinks are depending of your package all included, If a drink mentioned as communicated on our website is not available we will provide other options if provisions are stocked. If the Captain deems that guest(s) are getting irresponsibly due to alcohol consumption he has to right to deny drinks containing alcohol.
CHARTER: A boat charter is a service in which a boat and/or its crew are rented out to a customer for a period of time. A charter is usually organised by one person that then is responsible to inform his or her co-passengers about the terms and conditions.
